BASF’s Balancing Act: A Texas Patent Battle With Apple Meets a Cooling Analyst View at Home

The contrast could hardly be starker. On one side, a subsidiary of the German chemicals giant is pressing patent-infringement claims against the world’s most valuable consumer electronics maker. On the other, a domestic research house has just trimmed its recommendation on the parent company’s stock — not because of any operational stumble, but precisely because the shares have run so far, so fast.

The two developments, landing within days of each other, capture the peculiar position BASF finds itself in during late summer: a company delivering on its turnaround promises, yet facing questions about how much of that good news is already reflected in the price.

A Legal Gambit in West Texas

The more eye-catching news came from the courtroom. trinamiX, BASF’s wholly-owned subsidiary specialising in sensor and optical recognition technology, filed suit on Thursday in the U.S. District Court in Midland, Texas, alleging that Apple’s Face ID system infringes seven of its patents covering facial authentication.

The complaint, filed under case number 7:26-cv-00348, targets the Face ID technology embedded in the iPhone 15, 16 and 17 line-ups as well as the iPad Pro. trinamiX is seeking an injunction, though the filing does not specify a concrete damages figure.

The choice of venue is telling. Midland has become a favoured battleground for patent disputes against major tech firms, and the stakes here are considerable. Apple generated roughly $196.5 billion in iPhone revenue alone in the nine months through June 27, with iPads contributing an additional $21.7 billion. Should trinamiX prevail, it would be laying claim to a slice of one of the most lucrative product ecosystems in corporate history.

For BASF shareholders, however, the immediate impact appears limited. The shares barely moved on the news, trading at €53.31 — essentially flat on the day — after some intraday volatility around the announcement. Legal proceedings of this magnitude typically drag on for months or years, and with neither the damages quantum nor the timeline established, the market has largely shrugged.

That said, the case carries option value. A favourable ruling could open the door not just to damages but to recurring licence income from Apple’s vast device ecosystem — a potentially high-margin revenue stream that would sit neatly alongside BASF’s core chemicals operations.

The Analyst Downgrade That Says More About the Rally Than the Company

Back in Frankfurt, the mood is more measured. On August 29, mwb research lowered its rating on BASF from “Buy” to “Hold,” while leaving its price target unchanged at €55.

Should investors sell immediately? Or is it worth buying BASF?

The timing is instructive. This is not a downgrade born of deteriorating fundamentals — quite the opposite. The second quarter delivered an earnings before special items figure of €2.4 billion, comfortably ahead of market expectations. Revenue climbed 16 percent to €17.2 billion, driven by an 11.5 percent increase in prices and 7.3 percent volume growth.

Rather, the cut reflects valuation math. The stock has advanced roughly 20 percent since the start of the year, closing Friday at €53.33 — a mere 3.1 percent shy of its 52-week high. With the shares trading 6.7 percent above their 50-day moving average and the relative strength index sitting at 64.9, the technical picture suggests a stock that has absorbed much of its near-term upside.

The analyst community is far from unanimous, however. Berenberg and Jefferies both trimmed their price targets earlier in the summer — to €47 and €44 respectively, both with “Hold” ratings — but those adjustments predate the second-quarter results and the subsequent guidance lift, leaving them outdated as a reflection of current sentiment.

Catalysts Already Priced In

The market has had plenty to digest in recent weeks. The sale of the Coatings business to private equity firm Carlyle closed just over a month ago, a transaction valued at €7.7 billion that generated a post-tax divestment gain of €3.5 billion in the second quarter. The stock has climbed 14.1 percent since the deal’s completion.

More recently, management announced a share buyback programme of up to €1.0 billion, set to run until April 2027 as part of a broader €4 billion scheme extending through 2028. The announcement, made just over a week ago, has contributed a further 1.8 percent to the share price.

The guidance revision at the end of July — with EBITDA before special items now expected to land between €6.9 billion and €7.7 billion for the full year — provided the fundamental underpinning for the rally.

The Next Big Test

Looking further ahead, the planned initial public offering of the Agricultural Solutions division represents the next major strategic milestone. Shareholders approved the carve-out at the end of April, and a listing is targeted for the second quarter of 2027. Trade press reports suggest the division could be valued at €20 billion to €30 billion, with Deutsche Bank and Goldman Sachs mandated as lead banks on the preparation.

Board member Livio Tedeschi confirmed in August that the operational separation is largely complete in North and South America and Europe, with Asia expected to follow by year-end.

For investors, the immediate focus now shifts to October 28, when BASF releases its third-quarter figures. The question will be whether the positive pricing and volume momentum from the spring can be sustained — and whether the stock, having climbed so steadily, still has room to run.
